1. Acceptance of Terms

The Platform is owned and operated by Keyan North LLC, doing business as Keys To Your Breath. By accessing or using the Keys To Your Breath platform ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including visitors, registered members, and premium subscribers.

2. Eligibility

You must be at least 18 years of age to use this Platform. By using this Platform, you represent and warrant that:

• You are at least 18 years old (or the age of legal majority in your jurisdiction)
• You have the legal capacity to enter into these Terms
• Your use of the Platform does not violate any applicable law or regulation

Minors under 18 may only use the Platform under direct supervision of a parent or legal guardian who accepts these Terms on their behalf.

3. Health Disclaimer & Assumption of Risk

IMPORTANT: Breathwork is a powerful physiological practice. By using this Platform, you acknowledge and agree that:

• You have read and understood our Informed Consent document in its entirety
• You are physically and mentally fit to engage in breathwork practices
• You are not relying on this Platform as a substitute for professional medical advice, diagnosis, or treatment
• You voluntarily assume all risks associated with breathwork, including but not limited to altered states of consciousness, lightheadedness, tingling, and in rare cases, loss of consciousness
• You will stop immediately and seek medical care if you experience any alarming symptoms

4. Platform Services

Keyan North LLC dba Keys To Your Breath provides:

• Guided breathwork sessions (audio and video)
• Meditation and mindfulness content
• Educational resources about breathwork techniques and their physiological effects
• Live and recorded classes
• Community features and progress tracking tools
• One-on-one session requests with instructors

All content is for educational and general wellness purposes only. We reserve the right to modify, suspend, or discontinue any service at any time without notice.

5. User Accounts

When you create an account, you agree to:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used fraudulently or harmfully.

6. Payments, Subscriptions & Refunds

Certain features of the Platform require payment. All payments are processed securely through Base44 Payments.

• Subscriptions: Recurring subscriptions auto-renew until cancelled. You may cancel at any time from your account settings.
• One-time purchases: All sales are final unless otherwise stated.
• Refunds: Refund requests are considered on a case-by-case basis. Contact us within 7 days of purchase if you believe you are entitled to a refund.
• Price changes: We reserve the right to change prices at any time with reasonable notice to subscribers.

7. Prohibited Conduct

You agree not to:

• Share, reproduce, or distribute Platform content without written permission
• Use the Platform for any unlawful purpose
• Harass, threaten, or harm other users
• Attempt to gain unauthorized access to any part of the Platform
• Use automated bots, scrapers, or tools to access Platform content
• Post false, misleading, or harmful content in community features
• Impersonate any person or entity

8. Intellectual Property

All content on the Platform, including text, audio, video, graphics, logos, and software, is the property of Keyan North LLC dba Keys To Your Breath or its content licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform content for personal, non-commercial purposes only.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Keyan North LLC dba Keys To Your Breath and its officers, directors, employees, and agents shall not be liable for:

• Any injury, illness, or death arising from breathwork practice
• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, or business opportunities
• Any damages resulting from unauthorized access to your account

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Keyan North LLC dba Keys To Your Breath and its affiliates, officers, agents, and employees from any claim, liability, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, sending an email notification. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including disclaimer of warranties, limitation of liability, and indemnification.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Keyan North LLC operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
